Terms and conditions: 1. General
The Cafe Merci operates an order option for French patisserie & boulangerie. All contractual relationships between Cafe Merci's and its customers are exclusively subject to the general terms and conditions valid at the time of the conclusion of the contract. Individual agreements that deviate from these conditions are expressly confirmed in writing.
2. Conclusion of the contract
The presentation of products on the Internet or in other media by Cafe Merci is not a binding offer to sell. The order by the customer is a binding offer. Cafe Merci can accept this offer within two weeks by sending an order confirmation. A binding order can be placed by the customer via the Internet, e-mail, post or fax with full details of surname, first name, postal address, tel.-no. or email address and details of payment processing. The customer is obliged to provide the required information (name, address, etc.) truthfully and completely.
3. Prices, shipping costs
Orders from the customer are accepted at the current prices and conditions. All prices include the statutory VAT (7%) plus shipping costs.
4. Right of withdrawal and return
The consumer is entitled to withdraw from the contract if the goods ordered have not yet been delivered or handed over. According to § 1 Para. 3 Point 7 FernAbsG, the provisions on the right of withdrawal and right of return for food in distance sales contracts do not apply. According to the hygiene ordinance, re-placing food on the market is prohibited and therefore an exchange or return is excluded.
5. Delivery, delivery time, terms of delivery
The prerequisite for delivery is a binding order via the Internet, e-mail, post or fax with full details of surname, first name, postal address, phone no. or email address, details of payment processing and, if applicable, desired delivery date.
Cafe Merci tries to deliver your order as quickly as possible. We usually deliver within 4 working days. When shipping with the desired date, we take into account the average shipping time of the post. We cannot guarantee that the requested date will be met.
The customer must immediately report any products damaged in transit to the carrier.
If the delivery address is not given correctly or the recipient is not found or the package is not picked up from the post office, the customer is responsible. We reserve the right to invoice the full value of the goods.
6. Retention of title
We reserve title to the delivered item until all claims from the delivery contract have been paid in full.
7. Due Date and Payment
When paying by invoice, the invoice amount is due immediately without deduction.
8. Place of fulfillment, place of jurisdiction
This contract and all legal relationships between the parties are subject to the law of the Federal Republic of Germany to the exclusion of the UN Sales Convention (CISG). The place of performance is Dresden. This also applies to the place of jurisdiction if the customer is not a registered trader and we assert our rights in the dunning procedure.
This right also applies without restriction to deliveries to foreign customers.
9. Final provisions
Should individual provisions of this contract be ineffective, this shall not affect the remaining provisions
10. Return & Refund Policy
